Privacy, Terms and Conditions
Wash Crew provides laundry services for delivery customers. The following terms and conditions are an integral part of your customer profile and will be adhered to by the Wash Crew. The Wash Crew reserves the right to change these Terms and Conditions at any time without notice.
CUSTOMER PROFILE
The information contained on the customer profile will only be used by the Wash Crew. It does not sell, or provide to third parties, its customer list or any information provided on the customer profile. While you are an active the Wash Crew customer, the Wash Crew requires you to keep the customer profile current. The customer profile enables the Wash Crew to better serve you by (i) processing your garments in accordance with your preferences; (ii) contacting you about garment problems; (iii) mailing special the Wash Crew promotional materials; (iv) accepting your personal checks without check verification; and (v) processing your credit cards.
USE OF YOUR INFORMATION
We may use your information to: Enhance or improve User experience, our Site, or our Service. Process transactions. Send e-mails about our Site or respond to inquiries. Send e-mails and updates about the Wash Crew, including news and notifications about amended legal documents such as these Terms and Conditions. Perform any other function that we believe in good faith is necessary to protect the security or proper functioning of our Site or Service.
DELIVERY SERVICE
Delivery customers receive pick-up and delivery of laundry at no extra charge. Your laundry will be picked-up and delivered in accordance with the selections you make while placing your order. No pick-up and delivery service will be provided on holidays when the Wash Crew is closed.
DROP-OFF AND DELIVERY BAGS
The Wash Crew laundry bags are provided free of charge to our Wash Crew customers.
CARE LABEL INSTRUCTIONS
To protect your garments, the Wash Crew follows the Care Label instructions on each item it processes. To the extent you desire to not have the Care Label instructions followed, a Garment Release is required, and you assume all liability for the garment. If a Care Label is missing or has been removed from a garment, the Wash Crew will process the garment in accordance with guidelines for that type of garment established by the Dry Cleaning & Laundry Institute. the Wash Crew assumes no liability for garments that have missing or removed Care Labels.
LIMITED LIABILITY
The Wash Crew assumes no liability for items left with the Wash Crew over 30 days and may dispose of them without liability. Any differences in the number of items brought to the Wash Crew versus the number returned to you, or any damage to an item, must be reported to the Wash Crew within 48 hours of pick-up or delivery of the item(s).
You understand that there is inherent risk in the Cleaning Services and there is potential for clothing and related items to get lost or damaged. The Wash Crew has implemented measures designed to prevent the situations of lost or damaged items from happening, but the Wash Crew cannot guarantee that such situations will never happen. In the event that the clothing or other items that you sent to the Wash Crew is damaged or lost as a result of any fault of the Wash Crew (including our employees), we will work with you and endeavor to rectify the situation, provided that you provide us with written notification identifying the issues with your order of the Cleaning Services with supporting evidence within fourteen (48) hours of our delivery of your cleaned clothes and items for such order.
TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL ANY OF THE ORANGEBAG PARTIES BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, (B) ANY SUBSTITUTE GOODS, PRODUCTS, SERVICES OR TECHNOLOGY, (C) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF ONE-THOUSAND ($1,000) DOLLARS, (D) ANY MATTER BEYOND OUR REASONABLE CONTROL. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL OR CERTAIN OTHER DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU.
SECURITY
We take certain measures to enhance the security of our Site and Service, including using SSL certificates and PCI DSS-compliant hosting. However, we make no representations as to the security or privacy of your information. It is in our interest to keep our website secure, but we recommend that you use anti-virus software, firewalls, and other precautions to protect yourself from security threats.
FEES
Missed Pickup Fee: customers are responsible for ensuring laundry bags are ready/visible for collection. A fifteen-dollar ($15) fee is assessed in the event that a pickup is missed by the customer. The Wash Crew driver text, call, and text again. The driver will wait for a period of five (5) minutes before proceeding to the next pickup destination.
